Geoffrey Cox notes the legal risk 'remains unchanged' in relation to the UK being able to leave the backstop protocol arrangements if there was no act of 'bad faith' - it could just happen because of those intractable differences

IN A MUCH-ANTICIPATED piece of advice this morning, the Attorney General in the UK has said that the latest Brexit deal still presents a ‘legal risk’ of being trapped in the backstop protocol.

In his official legal opinion to the Prime Minister, Geoffrey Cox said that much of what was agreed between Theresa May and negotiators in Strasbourg last night bolstered the legal standing of the assurances given by the EU to the UK. “I now consider that the legally binding provisions of the Joint Instrument and the content of the Unilateral Declaration reduce the risk that the United Kingdom could be indefinitely and involuntarily detained within the Protocol’s provisions at least in so far as that situation had been brought about by the bad faith or want of best endeavours of the EU,” he notes.

However, he also noted that the legal risk “remains unchanged” in relation to the UK being able to leave the backstop protocol arrangements if there was no act of ‘bad faith’ on either side.

A large number of MPs and the DUP had earlier said they would not decide on their intentions for this evening’s vote on the deal until they had heard from Cox.As the clock ticks down, get all the best Brexit news and analysis in your inbox:

Same response.....to be in Govt!!!

What? You mean Ulster says “No!” Surely not? What happened to “Ulster will fight, and Ulster will be right?” Oh yeah, that was in response to devolution, which is also a disaster in the North.

As i keep saying if any proposal the DUP has to agree on benefits anything nationalist its going to be a NO. Even if it also benefits DUP. Cut of nose to spite face comes to mind.

Surprise , surprise,,, d u p. Disagree. With everything and always look miserable. They are a pitiful negative bunch

The DUP do not speak for the people of Northern Ireland, they are on a solo run.

NO is their default position after all !

That was to be expected

CalJamieson It wouldn’t of mattered if she brought it back with 20 billion pounds wrapped in a union flag and draped with an orange sash, they still wouldn’t of voted for it. There is no pleasing the fraudsters.

N what is new with that

Now there’s a shocker!
