The Special Criminal Court has allowed surveillance evidence in the Gerry Hutch murder trial – even though it found it was gathered illegally.
That was a key submission by Mr Hutch’s defence team who wanted the bug evidence gathered by the National Surveillance Unity excluded from the court. Presiding Judge Ms Justice Tara Burns told the court: “The officers form the National Surveillance Unit acted in good faith and any illegality was unknown.The decision is regarded as a major blow to Mr Hutch, with an address at the Paddocks, Clontarf, north Dublin.

mickthehack Nothing new in this. Precedent set in the People v Shaw & Evans in Court of Criminal Appeal 1979 on admissibility of illegally obtained evidence. Been argued since in a small few cases to Appeal & Supreme Court where 79 precedent has held. Same being argued in Graham Dwyer appeal

Garda recordings from North can be used in Hutch trialThe Special Criminal Court has ruled that secret garda recordings of conversations between Gerard Hutch and the former Sinn Féin councillor Jonathan Dowdall, while they were in Northern Ireland, can be used as evidence against Mr Hutch in a murder trial.
