In total, the Ireland’s case relies on nine legal arguments having launched the appeal in November 2016. Mischaracterises the activities and responsibilities of the Irish branches of Apple Sales International and Apple Operations Europe . These branches carried out routine functions, but all important decisions within ASI and AOE were made in the USA, and the profits deriving from these decisions were not properly attributable to the Irish branches of ASI and AOE.
Despite the appeal, Ireland collected the funds from Apple and is holding them in escrow until the appeal process is concluded. Approximately €13.1 billion in state aid and €1.2 billion in interest was deposited in the escrow account by Apple over the second and third quarters of last year.
