A New York designer is suing Kim Kardashian's SKIMS, alleging the brand intentionally copied her trademarked name 'Fits Everybody' for their successful shapewear line, causing significant damage to her smaller business.
A New York-based designer, Denise Cesare , is engaged in a legal battle with Kim Kardashian 's SKIMS , alleging trademark infringement. Cesare, owner of the apparel brand Fits Everybody To A T, claims SKIMS knowingly launched its ' Fits Everybody ' collection despite being repeatedly warned about the existing trademark.
The lawsuit, filed in the Southern District of New York, asserts that SKIMS leveraged its substantial financial resources and celebrity influence to dominate the market, disregarding Cesare’s prior claim to the name. Cesare established her brand nearly a decade ago, selling swimwear and clothing under the 'Fits' name. SKIMS, launched in 2019, quickly rose to prominence, with its 'Fits Everybody' line becoming a major revenue driver, reportedly generating between $700 million and $900 million.
The lawsuit argues that the striking similarity between the two brand names creates 'reverse confusion,' leading consumers to believe there is an affiliation between the established small business and the celebrity-backed SKIMS. Cesare’s legal team emphasizes that trademark law prioritizes first use, regardless of a company’s size or fame. They contend that SKIMS intentionally proceeded with the infringing name, believing it could simply outspend and outmarket any legal challenge from a smaller competitor.
The USPTO previously denied SKIMS’s trademark application for 'Fits Everybody' twice due to Cesare’s existing trademark. The legal complaint describes the situation as a classic case of a larger, well-funded company attempting to overshadow a vulnerable, smaller business. Cesare’s attorney, Jessica Mathews, highlights that her client built her brand from the ground up and was subsequently 'swamped and eclipsed' by SKIMS’s aggressive marketing and widespread reach.
The lawsuit details how SKIMS continued to expand its use of the name, launching new products and campaigns even after receiving objections. Cesare alleges that her business has been negatively impacted, with search engine rankings declining to the point of near invisibility. This dispute underscores the challenges faced by small businesses when competing with large corporations possessing significant resources and celebrity endorsements.
The core of the argument rests on the principle of trademark law, which protects established brands from being unfairly exploited by later entrants into the market, irrespective of their financial power or public profile.
