It came at the end of Prime Minister Justin Trudeau’s meticulously scripted press conference on Monday, flanked by his senior cabinet ministers, when he announced that he was invoking the Emergencies Act — the successor to the War Measures Act — for the first time since its proclamation in 1988.
You may even end up relieved to discover that the Emergencies Act will permit the federal government to commandeer tow trucks in order to put an end to the misery that Ottawa residents in the vicinity of the Parliamentary precincts have had to endure all these days.
So don’t be hard on yourself if you’re wondering what defensible rationale might be mounted to explain the necessity of invoking the Emergencies Act, because it certainly wasn’t the truckers’ scofflaw belligerence at the Ambassador Bridge border crossing. That yahoo barricade was already removed before the Emergencies Act was dusted off, and not by any strenuous exertions on Trudeau’s part.
It’s no trivial observation CCLA executive director Noa Mendelsohn Aviv makes when he says that whatever threats are posed by the protest leaders, it’s the Trudeau government’s brandishing of the emergency powers cudgel that “threatens our democracy and our civil liberties.” Not the Trailer Park Boys over on Wellington Street.
Well no, it did not. Unlike its War Measures Act predecessor, the Emergencies Act doesn’t even suspend civil rights in Canada. The Charter of Rights and Freedoms remains embedded in Canadian constitutional law. The flags are still flying on all government buildings, unlike the months on end when they weren’t last year owing to a whim that overcame Trudeau in his zeal to demonstrate just how deeply he cares about the Indigenous people of this country.

Let’s see, municipal and provincial governments were given adequate time to resolve the issue outside of federal jurisdiction. The premier asked for help and in order to legally supersede jurisdiction, the federal government correctly applied the necessary law… problem?
