School custodian refuses to download phone app that monitors location, says it got her fired

A school custodian says she was fired after refusing to put an app on her phone that checked her location, citing privacy concerns. As more people work remotely in the pandemic, "tattleware" that tracks employees’ productivity is on the rise, prompting lawyers to call for more protections.

cbcgopublic I wonder what her wages were per hour. Sometimes employers expect too much control for less than living wages. They want to 'geofence' instead of paying a supervisor. They are cutting their 'bottom line' to make more profit. Canada needs higher minimum wage or better unions

cbcgopublic The employer allowed her to not use the app for over two months. That’s consent. Firing her for cause citing the app after allowing her to work without it can be argued in arbitration as wrongful dismissal.

cbcgopublic It's WRONG for employers to track us - whether or not that is a legal wrong or just an ethical one I suppose will be fought in the courts over the next few years as more companies do this.

cbcgopublic Its her personal cell phone, if they want to monitor her gave her a work cell phone . I have my own phone, and have had company give out my cell number to customers, i told them if you want to pay my cell phone bill you can give out my number, but its my personal property.

cbcgopublic She's just being difficult and deserves to be fired. She could have handled this better by asking more questions and allowing her employer to resolve. Apparently there were other issues that lead to her firing. If she didn't show up or clean appropriately that's a problem.

cbcgopublic a contract for employment is signed with both parties agreeing to certain terms. There are other less invasive ways to track attendance/performance like punch clocks. What's to say someone doesn't leave their phone on site and the go to the mall?

cbcgopublic There's also a matter of economics here, too. How many minimum wage workers can afford a smartphone with that kind of capability, and why should they have that extra expense just to satisfy an employer?
