Opinion: Despite the need for conditional sentences that it recognized in 1999, the court last week upheld a 20\u002Dyear\u002Dold Indigenous woman\u0027s 18\u002Dmonth jail sentence

However, that comparison conceals more than it reveals since the U.S. is widely known for its mass incarceration of its own citizens. Canada’s incarceration rate is higher than many Western European countries, and is nearly double that of the Nordic nations to which we are often compared.

It gets worse still: Among youth, males make up 48 per cent and females 62 per cent of admissions to custody. So while their parents or grandparents spent their youth in residential schools, today’s Indigenous young people are spending it in jail. Nonetheless, in 2012, the government of Stephen Harper limited the availability of conditional sentences for certain offences, including those that carry a maximum sentence of 14 years in jail.

Despite the foregoing, the Supreme Court majority upheld the law because Sharma “adduced no statistical information” showing the law creates a distinction between Indigenous and non-Indigenous offenders.Article content
