The owner of a Lantzville daycare facing eviction next week is seeking an injunction banning its landlords from changing the locks on the municipal building it has been leasing.Courtney Dubyna, owner of the Thinking Garden Early Childcare Centre, went to B.C. Supreme Court this week to request an order prohibiting the District of Lantzville and the Seaside Community Society from changing the locks at 7244 Lantzville Rd.
Lantzville has been leasing the site to the society, which in turn has a sub-lease with the daycare signed March 8 of last year. Engineering reports done in 2013, 2019 and 2020 recommended that seismic upgrading be carried out on the building, a heritage church, to bring it up to current standards, a separate notice of civil claim states.
On April 21 of this year, the district sent Dubyna a letter ending her lease as of July 21, citing deficiencies in the building structure.Lantzville has said that it plans to lock the doors to the building on July 21, even though the lease requires six months notice of termination, Dubyna said.
Lantzville is community of fewer than 4,000 residents, located immediately north and adjacent to Nanaimo.A petition supporting Dubyna collected about 10,000 signatures.A society representative said it is not making a comment at this time.>>> To comment on this article, write a letter to the editor: letters@timescolonist.com
