Neither Whole Foods nor its lawyers immediately responded to requests for comment. A lawyer for the plaintiffs did not immediately respond to similar requests. It began as a proposed class action over a Whole Foods dress code that barred workers from wearing Black Lives Matter attire. Kinzer said she was fired in retaliation for"protected conduct" including protesting outside her store, rejecting demands to stop wearing a mask, talking to the press, and filing a complaint with the Equal Employment Opportunity Commission.
