A trial in the death of 44-year-old Richmond Hill father Peyman Masoomi Fard was thrown off this week after a key Crown witness momentarily contradicted his claim another man was driving — “I guess I was tired,” he clarified Wednesday.

A potential gotcha moment has arisen in a Newmarket trial that hinges on the question of who was behind the wheel of a speeding Mercedes that crossed into oncoming traffic, caused a multi-car collision and killed a 44-year-old Richmond Hill father.

Earlier in the day, the then-19-year-olds had been at a Persian community event at a water park. They had known each other in their native Iran, and had reconnected. When they left the water park, Riazi admits he was behind the wheel despite consuming alcohol. But he maintains that he let Hayatibahar drive after they stopped at a McDonald’s.

Throughout his testimony, Riazi maintained he was in the front passenger seat moments before the car spun out of control and ended on its side, killing Peyman Masoomi Fard, who was driving a Mazda. His wife and 12-year-old son were also seriously injured. An occupant of another car was also hurt. “I don’t remember to be honest,” replied the young man, wearing glasses and a T-shirt. Riazi called it “absurd” that Bytensky suggested he had asked Hayatibahar to claim he had been driving.
