Hǝ' Yǝł' Kǝn pleaded guilty to intentionally or recklessly causing damage by fire to a house on the reserve lands of the Wei Wai Kum First Nation in 2019.

A B.C. Indigenous man who burned his house down with his mother can’t argue he was punished twice for being both banished by his First Nation and jailed by the Crown, the provincial court of appeal has ruled.

Hǝ' Yǝł' Kǝn claimed in his appeal that he was punished twice for the offence with both the banishment and the prison time — known as double jeopardy. "Some of the material he placed before me may be relevant to the analysis ,” DeWitt-Van Oosten said. “However, it does not address the specifics underlying the Wei Wai Kum’s decision to banish the appellant from his reserve lands.”

“Towards the end of the recording inside the house Mr. Cliffe handed Ms. Olney a match and they discussed where the most effective place would be to light the fire. Ms. Olney paused and Mr. Cliffe asked if she was changing her mind,” the decision said. “She said she was not changing her mind. That she just wished to make sure the job was complete and there was ‘no coming back.’ She said ‘I’ll see you in jail, Chris,’ which is believed to refer to Chief Chris Roberts.
