The solicitor general said four experts had testified that McLellan was capable of returning to work, either as a youth care worker or in horticulture or in massage therapy, as he indicated would have liked to have done before he was injured.

“The judge concluded that the injury affected Mr. McLellan’s ‘disposition towards life’ and his ability to operate as a functional employee,” wrote Bennett. The trial judge also concluded McLellan had “no prospects for enjoyment of life and is in near constant pain,” she said.Article content And she said the trial judge found his treatment by the RCMP officers contributed to his fear of police, anxiety and depression, which is something close to post-traumatic stress disorder.

KB testified McLellan spoke to police that day as KB walked away and he turned to see McLellan showing officers his ID as police were yelling “Shut up and get your hands behind your back” and “Where’s the knife?”
