Wage theft affects millions of people, particularly women, people of color, and immigrants.
You can start protecting yourself from wage theft your very first day on the job. Keep a log of the dates you worked, the hours you worked, and when you took your breaks. Ideally, do so in pen in a notebook. Maryland labor attorney Bruce Godfrey says it’s a good idea to take a picture of your log every week and send it to a friend for safekeeping; that way, you can prove that the log was a continuously updated record of your work and not something you made after the fact.
Duman, of NICE, says it’s important that workers are “active in [record-keeping] from day one, because once you have accurate dates, once you have the information of the employer, it's much easier to pursue this process.” You can try filing a complaint with your state’s Department of Labor. Godfrey, the Maryland attorney, says there’s a lot of variability in how responsive different states are to citizen complaints. Depending on where you live, it could take a long time to get results.
Getting a lawyer for a wage theft case may sometimes be worth it. Wage theft cases are unusual because if you win,. So if you have a strong case, a lawyer may agree to represent you for no money up front. Again, the more coworkers you can convince to go forward with you, the stronger the case becomes.
