The state is experiencing one of the highest rates of Covid-19 infections in the country.
Evers’ emergency order establishing the mask mandate, which was imposed on Sept. 22 and will expire Nov. 21.
The case was brought by the conservative Wisconsin Institute for Law and Liberty, which argued that Evers was acting unlawfully by issuing successive emergency orders focused on the Covid-19 pandemic. Waterman said multiple orders are allowed “when the emergency conditions continue to exist,” but the judge did note that the Republican-led Wisconsin state legislature could overturn the mask mandate themselves if they wanted to.
