There are questions about why a registered sex offender, caught allegedly attacking a young girl in downtown Nashville this month, was on the streets.

She and her team are investigating Matthew Harber's case. She is concerned why he wasn’t in prison for a longer period for his previous offenses.Court records show Harber was convicted of sexual battery in 2006. That put Harber back on the street years earlier than if his original kidnapping charge had not been lessened.

Metro Judicial Magistrate David Ridings tells FOX 17 News a judge or jury can find someone like Harber guilty of a lesser included offense if the proof does not support the higher charge.
