Federal judges are deciding whether South Carolina’s new congressional maps are legal in a lawsuit by the NAACP which says the districts dilute Black voting power.

First, he wrote that the party challenging the constitutionality of the map must “disentangle race and politics if it wishes to prove that the legislature was motivated by race as opposed to partisanship.” He added that “we stand with a presumption that the legislature acted in good faith. Justice Elena Kagan dissented from the majority, saying, “What a message to send to state legislators and map makers about racial gerrymandering.”
