Defense attorneys asked for lesser sentences that would allow Toombs and Tucker to serve their time in county prison, but Peck imposed the state time citing the trauma to the victim and evidence presented at trial that the men had conspired after the fact to cover up the crime. Later that night, according to case files, she had a friend take her to a hospital to undergo a sexual assault examination, where a nurse noted multiple injuries to the victim’s mouth and vaginal areas.
