Two rape charges filed against Carlos “Scooby” Johnson, a former Butler basketball player, were dismissed before a jury trial began Monday.

He was on the bench during games, but after the rape allegation he was absent without explanation. Butler said in a statement on Aug. 12, 2021, after charges were filed against Johnson, that he was no longer enrolled and had not been allowed on campus since the date of the rape allegation.

“At the end of the trial, we will come back up here and ask you, after considering all the evidence, to hold the defendant accountable and find him guilty,” Huss told the jurors. The defense also said a nurse would testify that the woman’s injuries could have occurred during consensual sex and pointed to a deposition from last year where the woman stated she could not recall most of the details from the night she encountered Johnson.

Prosecutors began their case Monday afternoon by playing audio of the 911 call in which a friend of the woman’s calls and reports the woman was bleeding and had been raped. Then prosecutors called the woman to testify.From the witness stand she recalled details of the night outlined in the original probable cause affidavit for Johnson’s arrest, including that she had entered Johnson’s room willingly, fell asleep on his bed then was raped.
