The civil justice system in the United States, particularly its tort law framework, is fundamentally broken and in desperate need of reform. Originally designed to compensate victims of wrongdoing and to deter negligent behavior, it has devolved into an inefficient, unfair and often exploitative process that frequently fails to serve its intended purpose and levies significant costs on California families and businesses.
After hours of compelling testimony, which stressed the need for federal legislation that would increase transparency regarding third-party litigation funding and enact commonsense regulations on how this multibillion-dollar industry operates, Issa concluded the hearing by announcing that he would soon draft a third-party litigation funding disclosure bill.
The failure of the Legislature and the governor to enact stronger third-party litigation funding regulations leaves California businesses vulnerable to frivolous lawsuits and jeopardizes the communities that rely on these businesses and their services. This circumstance makes legislation like California Senate Bill 581 and Issa’s soon to be introduced bill more important now than ever.
