New bill heading to the governor would criminalize using AirTags to track another without consent.
Mobile tracking devices and stickers from the Metropolitan Police Department are seen on a table during an event where police officers distributed Apple AirTags and similar tracking devices to drivers in an attempt to curb a rise in crime in Washington on Tuesday, Nov. 7, 2023. COLUMBUS, Ohio – State lawmakers on Wednesday voted to close a legal loophole and prohibit a person from using an AirTag or similar device to track a person’s whereabouts without their consent.
Senate Bill 100 now heads to Gov. Mike DeWine’s desk. It creates a new first degree misdemeanor offense for the illegal use of a tracking device or application. However, that bumps up to a fourth-degree felony for a repeat offender, if the victim is under a protective order, if the offender has been deemed to pose a substantial risk of harm, or if the offender has a history of violence toward the victim.
Apple first released its AirTags in April 2021, a gamechanger for those who have forgotten a phone in a taxi or lost a suitcase in transit at the airport. Aware of the potential for abuse, Apple built in technology designed to stop unwanted tracking with the devices, but the system proved deficient.
