Domestic violence experts believe they are seeing a new level of protection for victims, after the SAFE-T-Act went into effect last month.
Christine Raffaele with Illinois Coalition Against Domestic Violence said suspects being able to bail their way out of jail under the old cash system -- didn't help protect the victims of domestic violence.
Someone would appear, they make their plea, the judge sets their bond then the case is over," Raffaele said. "And very rarely was any consideration given to the safety and security for the victimAnd another makes misdemeanor domestic violence battery charges detention-eligible So the person could be just as dangerous as somebody with a felony aggravated domestic violence battery charge," Raffaele said. "Therefore, they should be detention eligible even if the charge itself doesn’t reflect that dangerousness"Not only can you participate in your defense more if you're out, you're less likely to be forced into taking a plea or pressured into a taking plea for multiple reasons," Mansfield said.
Another protection in the SAFE-T Act requires victims to be notified if their abuser is released and under what conditions. WJI also says its pushing for law enforcement to be trained in recognizing survivors of domestic violence to prevent what it says are unnecessary arrests.
