Vince Vance, who's legal name is Andy Stone, is suing Carey, Sony Music Entertainment, and a co-writer of her 1994 Christmas hit.
He originally filed the lawsuit last year in Louisiana, but withdrew that, and today filed the suit in California.
Vince Vance says his attorneys are now moving forward to a financial conclusion either through settlement or trial.
