Mobile City Councilman again proposes ban on pre-dawn raids and no-knock warrants Mobile City Councilman Cory Penn's proposed ordinance that would ban no-knock search warrants and pre-dawn raids is once again on the council's agenda for consideration. There would be limited exceptions and the police chief and public safety director would have to approve them in writing. Penn says this ordinance puts the Mobile Police Department's current policy into law.
Mobile Police Chief Paul Prine issued a statement Monday saying his department already reached a mutual understanding with the council about those practices and questioned if the council can legally modify police guidelines. It's the same concern that caused the council to put the proposal on the back burner in December so attorneys could review it.
Mobile Chief of Staff James Barber said in an emailed statement the proposed ordinance is "very similar to polices Mayor Sandy Stimpson, Public Safety Director Rob Lasky and Chief Paul Prine have already put into place for the Mobile Police Department. The administration continues to seek clarification on whether the proposed ordinance would violate the Zoghby Act that defines Mobile’s current system of government or conflict with other state laws that govern police procedures.
