Christian Dow can’t bear the thought of allowing his mind to go back to that deadly night on I-15 in Utah County.“I have to not think about it, because if I do it tears me up. If I think about it right, there at 800 it just tears my heart out every single time. I have to block it out in order to drive I-15,” he said.
Referring to Toby, Dow said, “I didn’t want him to go, I couldn’t, I couldn’t lose her and him. I never left. I couldn’t leave his side.”All the while, Kesley Pope was not in jail. However, a hearing was held and prosecutors argued Pope was a flight risk because she possessed a passport and owned a business in Costa Rica and was ordered to surrender to jail.On Nov. 17, 2022, Pope made many calls from the Utah County Jail to her family.
Dow’s attorneys, Mark Flickinger and Daniel Woods of Flickinger Boulton Robson Weeks Law Firm filed a civil lawsuit against Kesley and her dad Jeff on behalf of their surviving children and Season’s dad, Dennis Froge. It states that for two of her traffic offenses, a letter was sent to her parents by the Justice Court clerk informing them of the charges against her. The lawsuit alleges Jeff “negligently entrusted” her with his truck and she was at-fault for driving drunk behind the wheel that night, killing Season and Toby.Court records show Kesley will be deposed from prison on September 9. She is representing herself.
