Town attorney say meeting that resulted in commissioner’s censure should have been public.
A Los Gatos town councilmember says he won’t take part in discussions about clarifying the town’s code of conduct.
The censured commissioner, Kylie Clark, is in a relationship with Councilmember Rob Moore, who is the chair of the policy committee, and Hudes said it’s not appropriate for Moore to provide feedback. He also voiced concerns about the ACLU’s threatening to sue the town over Clark’s censure. Town attorney Gabrielle Whelan said in her opinion, discussing changes to the code of conduct would not put the town in a bad position, nor would bringing the discussion to town council instead of the policy committee.
The committee, made up of town manager Laurel Prevetti, Whelan, Ristow and Vice Mayor Mary Badame, determined that her violation was minor in nature but warranted a major punishment. Los Gatos’ former town attorney Rob Schultz told Ristow in text messages obtained via a public records request that he felt the disciplinary process used against Clark didn’t follow the town’s code of conduct.
