Cruz, who is expected to run for president again in 2024, used the confirmation hearing to score points with the conservative base – accusing Jackson of promoting Critical Race Theory, an academic framework used to assess the way laws and public policy promote systemic racism.

Vermont Sen. Patrick Leahy, a Democrat who previously chaired the committee, said during Monday’s hearing that Republicans who “badgered” Jackson – a clear reference to Cruz, who got into a shouting match with the chairman at one point – actually helped prove why she deserves a seat on the Supreme Court.

On Monday, Cruz put the odds at “virtually 100%” that Jackson would vote to overturn gun rights, abortion restrictions and unlimited corporate campaign spending. He called it a near certainty that she would oppose school choice, and “it is 100% certain she will vote to overturn the death penalty.” Republican senators justified their harsh treatment and opposition by invoking confirmation fights dating to Reagan nominee Robert Bork, rehashing decades of ideological skirmishes and blockades in which neither party has clean hands.
