Brennand's attorneys argued the move is warranted because of"inflammatory publicity" of the case. Brennand was arrested for shooting Cantu in the parking lot of a McDonald's as the teen tried to drive away.
The entire case was refiled Feb. 27 to reflect changes to the charges Brennand is facing. He was previously facing two counts of aggravated assault by a public servant and one count of attempted murder; after re-indicting the case, the attempted murder charge was replaced with a count of deadly conduct.
