Disney had argued the widower's Disney+ contract would prevent the dispute reaching court.
Disney will no longer seek to block a widower's wrongful death lawsuit from heading to court, the company has said, following backlash.Jeffrey Piccolo's $50,000 suit alleged his wife, Kanokporn Tangsuan, died from an allergic reaction to a resort restaurant meal in October 2023. Walt Disney Parks and Resorts argued his Disney+ contract means any dispute cannot go to court, and asked for arbitration—often a more cost-effective route for companies.
Disney claimed the lawsuit should be removed from the court because Piccolo agreed to arbitration of all disputes with Disney when he signed up for a one-month trial of the Disney+ streaming service in 2019. Disney states in court documents that Disney+ terms and conditions say all disputes must go to binding, third-party arbitration and not to court.
