The Charter Review Commission explored the topic after recent indictment of former Councilmember Andrea Cardenas, who pleaded guilty to felony charges in February
Should a Chula Vista elected official facing felony charges be suspended from office? Should they receive their salary and benefits? What should happen to their staff? These are questions a subcommittee of the City Council may soon deliberate.
In recent months, commissioners considered the following: individuals should not be suspended unless proven guilty in court, but if they remained in office, that could affect the effectiveness and credibility of the City Council and any outside board they serve on during a criminal proceeding. The Commission looked at the city of Los Angeles’ charter as one Chula Vista could follow. Los Angeles’ charter allows the City Council to suspend an elected officer facing criminal proceedings.
