The lawsuit filed Monday claims the Biden administration is violating its authority by rewriting Title IX.

A coalition of state officials, students and parents is suing the Biden administration over its latest Title IX rules, calling the new regulations a violation of authority.last Friday, largely rewriting the 1972 federal civil rights law most known for ensuring equal treatment in women's sports.
"While different administrations can have different policy views, they cannot override the text that Congress enacted in 1972 or overrule the binding precedent of this circuit," the lawsuit reads. "The Biden rule does both—to the detriment of the states, their schools, and their students." The lawsuit argues broadening Title IX to include protections based on gender identity and sexual orientation "upends the foundation of women's sports," as well as contradicts previous rulings stating "misgendering" is not a violation of the law. Additionally, it claims the proposed changes to handling sexual harassment complaints eliminate "procedural safeguards for the accused.
Plaintiffs on the lawsuit include the state attorneys general of Alabama, Georgia, Florida and South Carolina, as well as advocacy groups Parents Defending Education , the Independent Women's Forum and Speech First."This Title IX rule is both unconstitutional and immoral, and we look forward to vindicating our members’ rights in court," PDE President Nicole Neily said in a statement.their school districts not to make policy changes based on the new regulations.
A spokesperson for the Education Department told Crisis in the Classroom while it "does not comment on pending litigation," it crafted the regulations "to give complete effect to the Title IX statutory guarantee that no person experiences sex discrimination in federally-funded education."Stay Connected
