After the Supreme Court gave power back to states to regulate abortion, the US Department of Health and Human Services issued a rule that Paxton says restricts when medical providers may share information with law enforcement officials. Paxton says it's a backdoor attempt to weaken Texas' laws with state investigations into medical procedures.
“This new rule actively undermines Congress’s clear statutory meaning when HIPAA was passed, and it reflects the Biden Administration’s disrespect for the law,” said Attorney General Paxton. “The federal government is attempting to undermine Texas’s law enforcement capabilities, and I will not allow this to happen.”
Paxton alleges that the original HIPPA statute preserves the right to investigative authority, and does not give HHS the authority to tell healthcare providers to refuse to cooperate with state investigations.
