'The draft direction clarifies that employees have a right to refuse to work if they have a reasonable belief that the necessary precautions have not been put in place to prevent the transmission of Covid-19' — Employment and Labour Minister Thulas Nxesi

Nxesi said this at the national command council economic cluster’s briefing on Friday. He said in consultation with all the social partners at Nedlac, they had drafted amendments to the directive issued on the April 29 when lockdown restrictions were moved to level 4.

As one of the key draft changes, Nxesi said: “The draft direction clarifies that employees have a right to refuse to work if they have a reasonable belief that the necessary precautions have not been put in place to prevent the transmission of Covid-19. “These disbursements have been in lieu of salaries that could not be paid or as a top-up where salaries have been reduced. Those 3 million recipients have families and dependents, greatly increasing the reach of the Covid-19 benefit scheme,” he said.

“This tells us that we need to intensify our screening and testing. Our insistence on screening and testing at mines has enabled us to detect the virus in the various mining areas. The mining industry has tested more than 4 600 people, of which 384 tested positive. That means of the 27 403 [as of Friday] cases in South Africa, 384 are in mining,” he said.
