Sikhakhane says a delay between June 2005 and July 2006 in the case cannot be blamed on Mr Zuma. The NPA had charged him without being ready. Judge Poyo-Dlwati points out that the NPA was not ready because of cases brought by Zuma's legal team challenging the legality of warrants used to raid his properties.Onto Vusi Pikoli now... Pikoli charged Zuma. He doesn't waste time, Sikhakhane says."And we agree. Because we are not here to say you must never charge Mr Zuma.

Sikhakhane:"We know, that when Mr Pikoli said let's charge Mr Zuma, they were not ready. Why were they not ready?" Sikhakhane: Mr Zuma was denied the opportunity to challenge evidence that implicated and prejudiced him ... So here is the crux of Sikhakhane's entire submission so far: Zuma, his client, was prejudiced and implicated by evidence led in the Shaik trial...because Zuma was not a co-accused. As he was not a co-accused, he could not cross-examine witnesses and so on. Judge Esther Steyn interrupts. She points out that Shaik was exercising his constitutional right to testify in his own defence. Sikhakhane: I cannot fault you on that. When there is evidence that says these people acted together...

Sikhakhane says the NPA believes his interpretation of this is that the decision was taken maliciously. But, he points out, the NPA does not disagree that the decision not to charge Zuma then, was and remains, wrong. Sikhakhane: When we complain about who is at fault for a delay... The point I am making for now, is that we said from that decision, the matter should have started.Icon

Zuma is in the dock as Advocate Billy Downer of the NPA wishes to adjourn the criminal matter to October 15, which will be after judgment has been delivered in this stay of prosecution matter. Zuma had a little spring in his step as he was excused from the dock, and has retaken his seat next to his legal counsel.
