Warwick Bloom of Hollard said Bopape's case was still open at the time of his application. He said the policy would not have come into existence if he had disclosed this.
He said this is why the policy was"voided", i.e. cancelled from inception, as if it had never existed in the first place. This voiding effectively means that no cover was in place in terms of the policy at the time of the accident. "It should be noted that in the same proposal form, Mr Bopape indicated that he understood the importance of the accuracy of his answers.
Bloom said the onus was on the insured to disclose all facts and to be completely honest and transparent at the time of applying for or taking out any insurance, so that they can enjoy the indemnity that insurance was meant to provide.
This is bad, but please do not play the tired race card. I know of lily-white people that had similar frivolous rejections of insurance claims. (Not Hollard). They persevered and made a noise on social media and ultimately won.
Hollard must pay. These frivolous excuses are mainly against non-white peoples. They are happy to take your money, but when it's time for them to Honour their part,.... Nothing
I wonder if they would have given someone of different race the same treatment!!!
