ANC secretary-general Ace Magashule has served the party with court papers in a bid to have his suspension declared unlawful.
He also wants the court to declare unconstitutional the ANC’s entire step-aside rule, which formed the basis of his suspension. Magashule argues in the court papers that rule 27.5 of the ANC’s constitution, which says those charged with corruption or criminal charges must step aside from their positions, failing which they be suspended, undermines the principle of innocent until proven guilty.

People do step aside from work while facing charges and investigations are in underway... to be reinstated when the process has been completed and are acquitted...how does that make them guilty while investigations are still on...

I find it very mischievous for leaders to run to court when they have failed to argue their stance within the political space. He is now basically saying what branches voted on at the NC is nonsense. where was he during those deliberations?
It's not a retaliatory suspension since he is the first one to suspend that big nose animal you call president, now you want to make everyone to believe he is retaliating. We know he wrote it first. Your unfair treatment to him is selling him to us .

This is interesting. We have a lot of public servants that are suspended with pay. Now if he wins that means they must go back.

Does he realize he is contradicting himself in his arguments? Almost as if winning the case is not his aim.

Has anybody said Ace is guilty? Is suspension at work whilst facing serious charges illegal ? I think not infact I think its a standard procedure to ensure and enforce credibility.

Would you have a doctor operate on you that is under investigation for malpractice? Suspension is not a conviction of guilt, it is a precautionary measure to prevent the possibility of further transgressions whilst guilt or innocence is determined.
oh wow...lol.. I don't know much about legal matters but i don't think he will win the request to have the court uphold the suspension of the president.
This argument will be true if a member was expelled from the party entirely due to the fact that they facing corruption or serious charges
