Jen Psaki defended the Biden administration’s shifting position on the legality of lengthening the federal eviction ban. “The president would not have supported moving forward if he did not support the legal justification,” she said.

White House press secretary Jen Psaki said the administration acknowledged that “this is not a permanent solution."

“The president would not have supported moving forward if he did not support the legal justification,” Psaki said during the daily press briefing. “He’s old-school in that way.” President Joe Biden indicated on Tuesday that he was unsure whether the policy would hold up in court, given a recent Supreme Court ruling that questioned the recently expired moratorium, but signaled that it nonetheless would provide some temporary relief to people at risk of losing their housing.

Psaki said the president’s comments should not be interpreted to mean the administration put forward a legally untenable proposal.
