Former President Donald Trump’s lawyers argued on Tuesday that a defeat in his lawsuit to keep Jan. 6-related records secret would unleash permanent political warfare between Congress and former presidents.

“In these hyperpartisan times, Congress will increasingly and inevitably use this new weapon to perpetually harass its political rival,” Trump attorneys Jesse Binnall and Justin Clark wrote in arguments filed with the U.S. Court of Appeals for the D.C. Circuit.

Trump is asking the appeals court to grant a stay that would block the House select committee investigating the storming of the Capitol from receiving Trump-era presidential records it has requested from the National Archives. Their request triggered a complex process — set out in federal recordkeeping laws — that included asking President Joe Biden for sign-off and then offering Trump a chance to object.

Trump’s lawyers also repeatedly pilloried Biden’s decision not to back his predecessor’s privilege claim, alleging that Biden’s stance was driven by “political calculations.” Chutkan, in her ruling, made clear she agrees with most legal scholars that the incumbent president’s authority on matters of privilege far outweigh the interests of a former president, who no longer holds any executive authority. Presidents, by nature, protect the prerogatives of the executive branch and are better suited to determine what should be kept secret and what should be released.

They mean like digging through every aspect of his personal life until they find something to pin on him. Exactly like what Republicans did to Bill Clinton in the 90s. They don't want their own tactics used on them. Makes sense of course. Total hypocrites!!!

We should have the rights to 'probe' documents. Particularly interested in those that show corruption in our elected officials and those they hired on my dime.

1/2 Interesting, but unlikely a sitting Pres would waive privilege of a predecessor going fwd. The situation is unprecedented. We've never had a Pres try to block the peaceful transfer of power following a free abs fair election - as proven over and over in the courts.

Only if there is an obvious reason to do such a search, like committing treason or a crime!

Nobody is legally harassing Carter, Bush II or Obama. The GQP tries to harass Clinton, but it’s mostly smoke & mirrors. If a former president is being sued and/ or investigated after leaving office, it’s probably bc he deserves it.

it’s a big one, and it’s the right one. this is definitely the time to do it. the flip-side of the coin is that a President can incite an insurrection and never be investigated for it, and i think we can agree that would be wrong.

There is no proof in those accusations/assumptions. Every President must be held accountable for his thoughts and actions, to include after they leave office.

No one should be above the law, even the President, regardless of party affiliation.
