Washington The Supreme Court agreed on Monday to take up a case next term brought by three Muslim men who seek to challenge the FBI, arguing that it unlawfully used a confidential informant to gather information about Muslims in their neighborhood based on their religious identity.

A district court had dismissed the claims under the so-called state secrets privilege"which permits the government under some circumstances to block the release of information in a lawsuit that could harm national security.
