Transcripts of the hearing were not immediately released.Smith was convicted of second-degree murder in 1994 for luring Derrick Robie into woods near the younger boy’s home and striking his head with a rock. Robie was walking alone to summer camp at a park in the Steuben County village of Savona in August 1993.

The case got wide publicity because of the tender age of the victim and suspect, along with a widely circulated photo of the adolescent Smith in court, wearing a Bugs Bunny sweatshirt and a mop of red hair.Smith’s lawyer unsuccessfully argued that he was mentally ill. Smith was sentenced to nine years to life in prison.

ADVERTISEMENTDerrick’s parents, Dale and Doreen Robie, opposed Smith’s release each time it was previously considered and have lobbied for parole reforms that include extending the time between hearings for violent offenders from the current two years to five.

Dale Robie told local media the family did not want to comment on the latest decision.Smith is housed at the medium-security Woodbourne Correctional Facility in the Catskills. Read more: The Associated Press »

Tom Holland surprised fans at a launch event in Sherman Oaks, Calif., where the mood was electric.

If this happened to my son and they let his killer out I would be furious. If the victim's Dad hunts this POS down and takes care of it himself I wouldn't be sad at all. The guy is a fucking monster, and so many people on this thread are treating him like a sob story… wonder if that four-year-old will also be getting a second chance at ?freedom?”

This animal should never be allowed out of cage. Court's FAILED! Never trust a ginger. They have no souls. I remember this case. I don't know he did terrible things to that child. ...but black men who were caught with 2 joints are locked up for decades with zero chance of parole. Sounds about white. He looks like a child of Donald Trump....

I’ve followed this tragic story since day one. I think he’ll do well in society if given the chance. I remember this story growing up. I remember that picture of the kid. Wrong kind of nostalgia. 41?! Na keep em in there

He's going to be lost. Think of everything that's changed in 30 years. He's never used a computer, maybe in prison. The world moves much faster now, he'll be lost. whoa. I remember this. He did more than just kill him. If I remember correctly he sodomized the kid post mortem also. Idk about releasing this one

NOOOOOOO!!!!!! Oh great, that’s just what we need, another psychopath on the streets. What could possibly go wrong… He looks pretty good for being 41 years old. 'Honey, we have a new neighbor. Hope he's nice' So if you have the time, the 11th try is the charm. Pathetic! As a country, we need to decide what prison is supposed to provide. If prison is meant to rehabilitate offenders then programs need to be provided in prisons so people come out the other end better than they went in. Currently, prisons produce better criminals. Don’t let him out. There’s no point and the parents will always be serving their life sentence.

Lourdes Leon opens up about mom Madonna: 'She has controlled me my whole life’The 25-year-old chatted with actor Debi Mazar in a new Q&A for Interview magazine. I’m sure her mother controlled the money machine. What did she do on her own without her moms help that allowed her to pay for college with her own money? Just curious. Also, she must know that getting into modeling would have been a LOT harder for her without her having her moms name/attachment (if at all) She said she became independent at 18. Paid for her college & apartment herself. She must’ve had a trust fund or something because The University of Michigan is about 60k a year, not including other expenses. No way she had that kind of money on her own.
