The Biden admin. will move to publish a federal rule this week to protect children brought to the US illegally by their migrant parents prior to 2007, known as Dreamers, after a court in Texas dealt a major blow to the Obama-era rule, DHS says.
The new rule will modify DACA, or Deferred Action for Childhood Arrivals, in an effort to “preserve and fortify” it against future legal challenges.
01:48It was not immediately clear how the new policy would be different and more protected against legal challenges. In a statement, Homeland Security said “the rule embraces the consistent judgment that has been maintained by the Department — and by three presidential administrations since the policy first was announced — that DACA recipients should not be a priority for removal.”
Homeland Security Secretary Alejandro Mayorkas said in the statement that"only Congress can provide permanent protection” for Dreamers. The July ruling came in a lawsuit brought by Texas and eight other Republican-led states. They claimed that the Obama administration violated the Administrative Procedure Act with the creation of DACA when it failed to first publish the proposal and to seek public comment before it tried to enforce it.
U.S. District Court Judge Andrew Hanen in Brownsville, Texas, said the Obama administration failed to follow federal administrative rules in launching theDeferred Action for Childhood Arrivals programin 2012. But he put the effect of most of his ruling on hold while the case is appealed. headtopics.com
The status of people currently in the program does not change, and they can continue to seek renewal of their DACA status. But Hanen said Homeland Security cannot grant any new applications from people who have never been in the program.Julia Ainsley Read more: NBC News »

Homeland Security chief Mayorkas defends Biden administration over treatment of Haitian migrantsHomeland Security Sec. Mayorkas fends off criticism of the Biden administration's handling of the crisis at the border, specifically on Haitian migrants who had been encamped underneath a bridge in Del Rio, Texas. Good, because those caravans originated from Brazil with the help of Jason Miller and Steve Bannon. Miller just went to Brazil to meet with Bolsonaro. Do you people think the Haitians walked here? They were driven! JoeNBC morningmika JonLemire No need to defend him, he's doing great!!! This claim has been proven to be a lie, but this doesn't stop leftist publications and even the President from nasty attempts to demean border agents who are trying to to do their legal job, and stop illegal immigrants from breaking US law.
Biden in a bind on border: 'The coalition that elected him will collapse'President Biden is stuck between immigration advocates in his own party on one side and Republicans, who insist he’s still not doing enough to control the border, on the other. It's not about a president in a bind, but a country of immigrants are in a bind about immigrants at our borders. We make it too much about political party in executive branch, this is an existential American crisis. President Biden is doing a fantastic job cleaning up the trump swamp. Yay Joe! People are expecting Biden to take in massive amounts of refugees from Honduras, Guatemala, El Salvador, Mexico, Afganistan and Haiti. Where will we house them? How will we integrate them? The southern border is going to continue being an issue for every president.
Biden in a bind on border: 'The coalition that elected him will collapse'Democratic Rep. Ayanna Pressley, of Massachusetts, called the Border Patrol “egregious and white supremacist.” Rep. Maxine Waters, D-Calif., said it was “worse than what we witnessed in slavery.” Absolutely 💯 Of course, Maxine Waters is batsh*t crazy, but worse than slavery? Using her comparison, then, slavery wasn't all that bad. I'm glad she acknowledged that. If I, as a white dude, had said it, I'd be called a racist.
Biden, Congress Face Big Week For Agenda, Government FundingBiden’s domestic agenda hangs in the balance, at risk of collapse and political fallout if he and Democratic leaders cannot pull their party together. Isn’t it way past time for media to stop focusing on the President and start focusing on obstructionists in Congress!! When are you all gonna start doing that? You are not building back anything. Stop talking about doing it and do it. End the filibuster and pass the laws. Do the job you were elected to do. America can't wait much longer.
Border Patrol agents who Biden said would ‘pay’ could get minimal punishment, officials sayThe Border Patrol agents who were pictured blocking migrants on horseback in Del Rio and who President Biden promised would 'pay' as he echoed false claims the agents 'strapped' migrants -- could get little more than a few days suspension, if the investigation turns out as some senior administration officials hope.
