Woman fails in bid to sue NHS over claims it had duty of care to tell about her father's fatal, inherited brain condition

A woman who claimed she would have had an abortion if she had known her father had a fatal, inherited brain condition has failed in her bid to sue the NHS.

In her judgement at the court in London, Mrs Justice Yip found that, on the balance of probabilities, the claimant would not have gone ahead with a termination of her pregnancy if she had been made aware of the risk. Her father had told doctors he did not want his daughter told about his diagnosis, fearing she might kill herself or have an abortion if she found out.

ABC's father tested positive for the condition in 2007 after he killed her mother and was detained under the Mental Health Act.

Well at least the NHS wont be paying out large sums of money,just saying.

Sorry to hear this. It’s the father who was at fault if witnesses are telling the truth. Drs are known to cover each other’s backs.

Her father should have been advised upfront about his condition

“ABC's father tested positive for the condition in 2007 after he killed her mother and was detained under the Mental Health Act.” Doesnt this mean he’s not mentally in a fit state to agree or disagree to disclose any info? It shouldn’t be his choice anymore.

She has a point but the hospital was in a no-win situation. Ultimately this is probably the right decision.
