University of Sheffield researchers believe the pitfalls could be contributing to unfair ‘Failure to Provide’ convictions

Women, short people, old people, and smokers over 40 may be physically incapable of using police breathalysers. .

Lead researcher Galen Ives, University of Sheffield’s Information School, said: “Although there are procedures currently in place to gather alternative samples in cases where someone using an evidential breath test machine fails to provide a valid sample, the current belief by the authorities is that unless they have a respiratory illness, everyone should be able to use them.

The researchers said there was “a severe lack of data” on breathalysers, with just 300 people tested to see how valid the machines are. Any legal defence requires a documented medical history such as asthma, chronic obstructive pulmonary disease , or severe anxiety to justify the botched test.
