A lorry driver who sarcastically clapped a motorist moments before he knocked down and killed a young boy on a pedestrian crossing was today cleared of causing death by dangerous driving.
A court heard that Phoenix had been distracted at the time because he was ‘sarcastically clapping’ another motorist just as he drove off. He was today found not guilty by a jury following a two day trial at Bournemouth Crown Court, Dorset.On hearing the verdict Jaiden’s distraught parents, James Mangan and Yasmin Dougan, broke down in tears and stormed out of court.Lorry driver Dean Phoenix hit the three-year-old at the crossing
The court heard Phoenix had become frustrated after an elderly motorist illegally parked his car on the zig zag lines on the crossing, blocking the lorry’s path.
