Homeless arsonist, 49, who set fire to Fox News Christmas tree is free again

Craig Tamanaha, 49, was taken into custody in Times Square on Wednesday morning at around 12.15am. He climbed the Fox News Christmas tree and set fire to it with a lighter then tried to run away but was caught. He has a prior record for flashing and drugs possession and his father has described him as mentally ill. He was charged with six misdemeanors for the Times Square stunt - but walked because all were misdemeanors.

Misdemeanors are generally not jail sentences in the US. It’s got nothing to do with the mayor. Especially true in the mentally ill, courts will try to get them into treatment before resorting to jail.
