Senators flagged on Wednesday the National Telecommunication Commission’s “inconsistency” in exercising its authority over the operations of companies without valid permits and legislative franchises.

Cordoba said that the NTC has been allowing the operations of entities pending the renewal of their licenses. He, however, admitted that the NTC, in the past, did not stop the operations of broadcast companies whose franchise renewal applications were pending in the legislative branch. “The difference from those instances and the ABS-CBN is that in ABS-CBN, a case for quo warranto was actually filed by the Office of the Solicitor General. Kaya it became untenable on our part to let it continue, because of the clear tenor of the law,” Cordoba said, citing RA No. 3846.

“This representation sees the very clear inconsistency in the manner which the NTC has applied its power to issue a cease and desist order. There was no cease and desist order issued to various franchises which have expired while the application is pending in Congress, while, as the [NTC] commissioner said, there were radio stations which were operating without a franchise who were issued cease and desist order,” Drilon, author of the SB 1530, noted.

Pangilinan also noted the “conflict” between Cordoba’s statements with the previous pronouncements of his deputies.
