The Supreme Court (SC) said on Thursday it has not ruled on the administrative liability of Julito D. Vitriolo, then executive director of the Commission on Higher Education (CHEd), who was ordered dismissed from the service by the Office of the Ombudsman (OMB) in 2016 for gross neglect of duty, grave misconduct, inefficiency, and incompetence.

Through its public information office , the SC said the challenge on the administrative liability of Vitriolo is still pending resolution on its merits based on a petition filed by complainant Oliver B. Felix who challenged the 2017 and 2018 rulings of the Court of Appeals .

On Jan. 29, 2018, the CA denied the OMB’s motion to intervene in the petition filed by Vitriolo with a ruling, among other things, that the OMB’s motion was filed only on Sept. 28, 2017, while the decision was handed down on Aug. 17, 2017. The SC ruled that “while the Ombudsman had legal interest to intervene in the proceedings in CA-G.R. SP No. 149063, the CA correctly denied the intervention prayed for as records show that the Omnibus Motion was filed only on September 28, 2017, or a month after the promulgation of the CA’s Decision on August 17, 2017.”

The administrative complaint against Vitriolo arose from Felix’s accusations that as CHEd executive director the former prevented the issuance of a certification that the Pamantasan ng Lungsod ng Maynila was not authorized by CHEd to implement the Expanded Tertiary Education Equivalent Accreditation program .

On May 19, 2011, Felix, a former faculty member of the College of Physical Education at PLM, filed a complaint against Vitriolo before the OMB for grave misconduct, gross neglect of duty, incompetence, and inefficiency in the performance of official duties.
