The IRR of the anti-terror law 'dilutes' the long-standing standard of probable cause, says criminal law expert Ted Te.

of the anti-terror law allows the non-judicial Anti-Terror Council to designate persons as"terrorists" and publish their names on newspapers and government websites based on"reasonable ground of suspicion."

"Probable cause under the Constitution has a well-accepted definition. The standard inserted by the IRR dilutes the standard of probable cause, as defined by the cases," said criminal law expert Ted Te, former Supreme Court spokesperson. Justice Undersecretary Adrian Sugay said that the definition of probable cause is sourced from the Supreme Court itself.on warrantless searches where the Court said that "probable cause was defined as a reasonable ground of suspicion supported by circumstances sufficiently strong in themselves to warrant a cautious man to believe that the person accused is guilty of the offense with which he is charged.

The general explanation on IRRs frequently used by lawyers is that"the water cannot rise above the source," meaning the IRR cannot substantially change what the law says. Veloso was able to win that relief after a second try at the CA and on a petition for the writ of habeas data. Habeas data privileges, if granted, would order the government to destroy the damaging information.

Anti-Terrorism Council to publish names of alleged 'terrorists'There goes this government again. In their so-called narco list so many generals have been named including Espenido but nothing has been done. Evidently, selective drug war. Now they will publish their terrorists list without court declaration. Might as well post the narco lists. “alleged”....can be anyone. this is like drug list....and will spread up to social media....same propaganda
