DOLE: One-month ECQ not counted as part of probationary period
Private sector employers and probationary employees take note.
“For purposes of determining the six-month probationary period, the one-month ECQ period is not included thereof,” DOLE said in Labor Advisory No. 14-2020 dated March 30.“This advisory shall apply to all employers in the private sector who are required under Article 296 of the Labor Code…to comply with the probationary employment period not to exceed six months from the date the employee started working,” it further read.
“Technically there is no work during the lockdown,” DOLE Bureau of Local Employment Director Dominique Tutay said in an interview. “The probationary period is extended.”Under the Labor Code, probationary employment shall not exceed six months from the date the employee started working.
An employee, who is allowed to work after his/her probationary period, shall be considered as a regular employee already.The DOLE already instructed their Regional/ Provincial/ Field Office to monitor the implementation of the issuance. Read more: Manila Bulletin News »
