According to the 25-page lawsuit, the Bernard family was in the lobby of St. David’s around 5:35 p.m. on Feb. 13. Mrs. Bernard was waiting for test results in the emergency room . Her husband, along with her two young children, was there to pick her up.
"The Austin Police Department has indicated Ms. Holloway accidentally lost control of the vehicle,” the lawsuit said. “She crashed through the hospital’s vulnerable and unprotected ER entrance and into the lobby, running over and severely injuring the entire Bernard Family.” “The aquarium, unlike a bollard, is full of glass and sand that literally turns into an improvised explosive device when struck by a car, sending vicious and deadly shrapnel into victims and compounding the already devastating effects of being smashed by a car,” the lawsuit said.
