Bercakap kepada Utusan Malaysia, peguam mewakili Sam Ke Ting, Muhammad Faizal Mokhtar berkata, pihaknya telah memfailkan kebenaran merayu dan perakuan segera melalui sistem e-filing mahkamah.“Kami mengemukakan kedua-dua permohonan itu hari ini (semalam),” katanya.20am on Feb 18, 2017.Pemandu wanita itu yang sebelum ini dilepas dan dibebaskan daripada tuduhan memandu secara melulu sehingga menyebabkan kematian lapan remaja menaiki basikal lajak lima tahun lalu, dijatuhi hukuman penjara enam tahun bermula kelmarin.High Court Judge Abu Bakar Katar said the Magistrate’s Court erred in failing to decide on the respondent's defence without her being under oath.Keputusan itu dibuat Hakim Mahkamah Tinggi, Datuk Abu Bakar Katar selepas mendapati pihak pendakwaan berjaya memutuskan kes prima facie di akhir kes pendakwaan.“The respondent, in her defence, stated that she did not see the group of cyclists at the scene of incident and there was other vehicle that hit the deceased bicycles and drove off.Mahkamah turut menjatuhi hukuman denda sebanyak RM6,000 kepada Ke Ting, 27, yang mana jika gagal bayar akan ditambah hukuman penjara enam bulan dan tertuduh juga hilang kelayakan lesen memandu selama tiga tahun sebaik sahaja selesai menjalani tempoh hukuman.

Peguam wanita itu turut memohon penangguhan pelaksanaan hukuman ke atas responden yang mana hukuman bermula dari tarikh sabitan, bagaimanapun hakim tidak membenarkan penangguhan selagi tidak menerima kebenaran merayu daripada Mahkamah Rayuan.“The Magistrate’s Court made a mistake when it accepted the respondent’s defence for not knowing there would be basikal lajak activity during the time of the incident as an excuse to drive dangerously, which resulted in the victims’ death,” he added.“The Magistrate’s Court made a mistake when it accepted the respondent’s defence of not knowing there would be basikal lajak activity during the time of the incident as an excuse to drive dangerously, which resulted in the victims’ death,” he added.Pada 10 Oktober tahun lalu, Mahkamah Majistret Johor Bahru mengekalkan keputusan tertuduh dilepas dan dibebaskan daripada tuduhan berkenaan yang berlaku pada 18 Februari 2017.Berdasarkan kertas pertuduhan, Ke Ting yang ketika kejadian berusia 22 tahun didakwa memandu kereta bernombor pendaftaran JQB 9984 di Jalan Lingkaran Dalam secara melulu atau dengan berbahaya hingga menyebabkan kematian lapan penunggang basikal pada pukul 3.20am,” he added.20 pagi.Abu Bakar said with limited visibility, the respondent should have been aware of road safety if she drove her car beyond the speed limit of 50kph before reaching the scene of the incident.Kelapan-lapan mangsa terlibat ialah Mohamad Azrie Danish Zulkefli, 14 (ketika kejadian); Muhamad Shahrul Izzwan Azzuraimie, 14; Muhammad Firdauz Danish Mohd Azhar, 16; Fauzan Halmijan, 13; Mohamad Azhar Amir, 16; Muhammad Harith Iskandar Abdullah, 14; Muhammad Shahrul Nizam Marudin, 14 dan Haizad Kasrin, 16.He said this before the sentence was meted out against Sam at the Johor Baru High Court here on Wednesday (April 13).
